Independent Contractor or Employee?
 
This one detail has an immense effect on employment and unemployment claims. On January 5th, the U.S. Department of Labor developed a multi-factor test determining whether workers are independent contractors for purposes of the FLSA regarding overtime and minimum wage issues.
 
Despite this, the U.S. Supreme Court has stated numerous times that there is no rule or test that can determine whether a worker is an independent contractor or an employee. Our very own Kate Mowry takes a deep dive into the world of worker’s compensation and how Colorado uses a “right of control” test to identify whether a worker is an employee or an independent contractor.
